New services are added frequently and this agreement may therefore be modified and updated on an ongoing basis. It is your responsibility to check back to this page regularly. If any change is unacceptable to you, your sole recourse is to discontinue accessing or otherwise using Xume mobile apps and websites. Your continued use of the mobile app and websites shall constitute your acceptance of the Agreement as amended.
Updated (February 2016) - This policy overrides any pre-existing policies found on any Xume web and mobile properties.
xume.co are domains and Xume ioS, Android, Windows Apps are Mobile Apps owned by Maja Solutions LLP and referred as “Xume”or collectively as “Xume Sites”.
Agreement.Use of and access to Xume web, database, e-mail, and/or mobile application properties, as well as any related content, regardless of media, is subject to the terms, conditions, and disclaimers set forth below and to all applicable laws and regulations. Xume reserves the right to modify these disclaimers, terms, and conditions of access without advance notice. This agreement constitutes a binding contract between Xume and you, the user. By accessing one of Xume web, database, e-mail, and/or mobile application properties, you hereby accept this User Agreement in full. As a material condition of such access and use, you warrant that you have provided complete and accurate information in any communication with Xume.
Personal Use. Xume web, database, e-mail, and mobile application properties are provided solely for your personal, non-commercial use. They are meant to help consumers make informed choices and decisions about food products. You may not develop or derive for commercial sale, or any other use, any data in machine-readable or other form that incorporates or uses any substantial part of Xume web, database, e-mail, and/or mobile application properties, nor transfer to or store any data residing or exchanged over Xume web, database, e-mail, and/or mobile application properties in any electronic network for use by more than one user, unless you obtain prior written permission from Xume. Specifically, unless explicitly authorized in these terms and conditions, or by the owner of the materials, you may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium any material from Xume web, database, e-mail, and/or mobile application properties.
User Account:In order to access some features of these Xume Sites, you may have to create an account. When creating your account, you must provide accurate and complete information. You will never use another's account without permission.You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify Xume immediately of any breach of security or unauthorized use of your account. Although Xume will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of Xume or others due to such unauthorized use.
Dynamic Database. Xume web, database, and mobile application properties are dynamic. This means that product ratings may change based on evolving science, new information, or other factors, as well as that the contents of e-mail messages and consumer guides may not reflect Xume current ratings or evaluations of products. Please be advised that Xume does not recommend that companies create marketing materials based on Xume web, database, and/or mobile application properties’ rating systems given that the ratings may change as the database is updated.
Xume makes no representations or warranties about any of the products rated on its web, database, and mobile application properties, or products referenced in e-mail messages. Xume hereby disclaims all warranties with regard to the products rated on its web, database, and mobile application properties, or products referenced in e-mail messages, including express warranties, statutory warranties, implied warranties of merchantability, or warranties of fitness for a particular purpose.
Xume further disclaims all warranties with regard to any products made available to members of the public by Xume, of fitness for a particular use.
Medical Advice: Xume is not a substitute for medical advice. Please check the food product label prior to consumption as the manufacturers have the right to alter their ingredients or change the formulation at will. While we work to ensure that the product information on our Xume Sites is correct, our analysis may be based on incomplete, outdated or inaccurate information. We recommend that you read product labels, warnings, and directions including food allergy information before consuming a food product. Also always consult a licensed medical practitioner if you suffer from any health conditions, allergies or before changing any dietary habits or consuming foods based on what you see or read on this Xume Sites."
Automated Access:You agree not to use or launch any automated system, including without limitation, "robots," "spiders," "offline readers," etc., that accesses the Xume Sites in a manner that sends more request messages to the Xume servers in a given period of time than a human can reasonably produce in the same period by using a convention on-line web browser. Notwithstanding the foregoing, Xume grants the operators of public search engines permission to use spiders to copy materials from the Xume Sites for the sole purpose of creating publicly available searchable indices of the materials, but not caches or archives of such materials. Xume reserves the right to revoke these exceptions either generally or in specific cases. You agree not to collect or harvest any personally identifiable information, including account names, from the Xume Sites, nor to use the communication systems provided by the Xume Sites for any commercial solicitation purposes. You agree not to solicit, for commercial purposes, any users of the Xume Sites with respect to their User Submissions. You agree not to license, lease, rent, sell, transfer, assign, distribute, host or otherwise commercially exploit Xume Sites. You shall not modify, make derivative works of, disassemble, reverse compile or reverse engineer any of the Xume Sites or content therein. You shall not access Xume Sites in order to build a similar or competitive service.
User Submissions
a. The Xume Sites provide a user Comment and Discussion feature, (feature allows for an interactive experience by integrating a commenting platform), by using this feature you understand and agree that we are providing a public comment sharing platform and that Xume or other Users may search for, see, use, re-post any of your User Content that you make publicly available through the feature, which you may use to post your views, comments and discussion material subject to the terms & condition of this agreement and in addition may now or in the future permit the submission of articles, recipe, food information, photos, videos or other communications submitted by you and other users (collectively known as "User Submissions") and the hosting, sharing, and/or publishing of such User Submissions. You understand that whether or not such User Submissions are published, Xume does not guarantee any confidentiality with respect to any submissions. Xume reserves the right to discontinue any aspect of the Websites at any time. Xume may use the services of a third party for the “Discussion” feature which stores the information on their servers. Please refer to their Privacy Policy and Terms of Service on that portal before using the feature on this site.
b. You shall be solely responsible for your own User Submissions and the consequences of posting or publishing them. In connection with User Submissions, you affirm, represent, and/or warrant that:
(i) you own or have the necessary licenses, rights, consents, and permissions to use and authorize Xume to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all User Submissions to enable inclusion and use of the User Submissions in the manner contemplated by the Websites and these Terms of Use; and
(ii) you have the written consent, release, and/or permission of each and every identifiable individual person in the User Submission to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of the User Submissions in the manner contemplated by the Website and these Terms of Use. By submitting the User Submissions to Xume, you hereby grant Xume a worldwide, non-exclusive, royalty-free, sub-licenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Submissions in connection with the Xume Websites (and its successor's) business, including without limitation for promoting and redistributing part or all of the Xume Sites (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user of the Xume Sites a non-exclusive license to access your User Submissions through the Xume Sites, and to use, reproduce, distribute, prepare derivative works of, display and perform such User Submissions as permitted through the functionality of the Xume Sites and under these Terms of Use. The foregoing license granted by you terminates once you remove or delete a User Submission from the Xume Sites.
c. In connection with User Submissions, you further agree that you will not:
(i) submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant Xume all of the license rights granted herein;
(ii) publish falsehoods or misrepresentations that could damage Xume or any third party;
(iii) submit material that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate;
(iv) post advertisements or solicitations of business:
(v) impersonate another person. Xume does not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and Xume expressly disclaims any and all liability in connection with User Submissions. Xume does not permit copyright infringing activities and infringement of intellectual property rights on its Websites, and will remove all Content and User Submissions if properly notified that such Content or User Submission infringes on another's intellectual property rights. Xume reserves the right to decide whether Content or a User Submission is appropriate and complies with these Terms of Use for violations other than copyright infringement and violations of intellectual property law, such as, but not limited to, pornography, obscene or defamatory material, or excessive length and also to remove Content and User Submissions without prior notice. Xume may remove such User Submissions and/or terminate a User's access for uploading such material in violation of these Terms of Use at any time, without prior notice and at its sole discretion.
d. Copyright owner or an agent thereof who believe that any User Submission or other content infringes upon your copyrights may submit a notification pursuant to the Indian Copyright Laws by providing our office with the following information in writing:
(i)A physical signed authority of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
(ii) Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
(iii) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit the service provider to locate the material;
(iv) Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and, if available, an electronic
(v) A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
(vi) A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. Such written notice should be sent to our Registered Office Address:

Please also note that any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability. Xume, in appropriate circumstances, may terminate authorization of users to its Websites who are repeated infringers.
Counter-Notification
If you elect to send us a counter notice, to be effective it must be a written communication provided to our Registered office address that includes substantially the following:
(i) A physical or electronic signature of the subscriber.
((ii) Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
(iii) A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
(iv) The subscriber's name, address, and telephone number, and a statement that the subscriber consents to the jurisdiction of Mumbai Court and that the subscriber will accept service of process from the person who provided notification or an agent of such person
e. You understand that when using the Xume, you will be exposed to User Submissions from a variety of sources, and that Xume is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such User Submissions. You further understand and acknowledge that you may be exposed to User Submissions that are inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against Xume with respect thereto, and agree to indemnify and hold Xume, its Owners/ Operators, affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to your use of the site.
Disclaimer of Products and their Analysis
ALL INFORMATION CONTAINED ABOUT PRODUCTS ON THE WEBSITE, APPS, AND CONTENT, INCLUDING NUTRIENT INFORMATION, INGREDIENTS, FOOD ALLERGENS, AND INFORMATION RELATING TO MEDICAL AND HEALTH CONDITIONS IS FOR INFORMATIONAL PURPOSES ONLY AND NOT PROVIDED AS MEDICAL ADVICE.
When considering any product, our rating and its food suitability on Xume WEBSITES, keep in mind:-
(i) Manufacturer ingredients/formulations can change at any time.
(ii) Xume's data may be outdated, erroneous or incomplete.

ALL PRODUCTS INFORMATION ANALYSISED on Xume are based its own proprietary algorithm rating devised on information that is publicly available on a product's package, the nutrition facts label and the ingredient list. Our analysis intends to create awareness amongst consumers of food products, based on generally accepted practises by nutritionists and that such consumers should check their personal suitability based on individual health and body constitution parameters as advised by medical professionals.
Xume's algorithm, does not qualify, disqualify, down grade, upgrade any products through its analysis, it merely tries to draw attention of the consumers of such products, their possible impact on intake of such products.

Copyright.Xume web, database, e-mail, and mobile application properties, and all other text and images contained in Xume products, are protected by Indian trademark and copyright law and/or other applicable law, and are the property of Xume, except as otherwise identified.
Xume respects others’ intellectual property rights, and reserves the right to delete or disable content alleged to be infringing from Xume web, database, e-mail, and mobile application properties and to terminate the accounts of repeat alleged infringers.

Indemnification. You hereby agree to indemnify, defend, and hold harmless Xume from and against any and all liability and costs incurred by Xume in connection with any claim arising out of any breach or alleged breach of any of your representations, warranties, or obligations set forth in this User Agreement. You shall cooperate as fully as reasonably required in the defense of any claim.

The product ratings, images, conclusions, recommendations, and findings that appear on Xume web, database, and mobile application properties, or in e-mail messages, reflect Xume research at the time of publication. Please be advised that this information frequently relies on data obtained from many sources, and accordingly, Xume cannot guarantee the accuracy of the information provided or any analysis based thereon. Moreover, in light of evolving regulatory and market conditions, subsequent product reformulations, and other factors, this information may no longer be current.

Xume FURTHER DISCLAIMS ALL WARRANTIES WITH REGARD TO ANY PRODUCTS MADE AVAILABLE TO MEMBERS OF THE PUBLIC BY Xume
Xume AND ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AND OTHER REPRESENTATIVES SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCES FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES, INCLUDING LOST PROFITS OR COSTS OR ATTORNEY'S FEES, UNDER ANY LEGAL THEORY INCLUDING, BUT NOT LIMITED TO, BREACH OF CONTRACT, BREACH OF WARRANTY, NEGLIGENCE, OR STRICT LIABILITY, REGARDLESS OF WHETHER Xume WAS INFORMED OF THE POSSIBILITY OF SUCH DAMAGES.

Xume web, database, e-mail, and mobile application properties may contain links and pointers to other sites on the Internet, which may be maintained by third-parties. Such links do not constitute an endorsement by Xume of any third-party site or any materials contained therein. Xume does not control, and is not responsible for, the availability, accuracy, privacy policy, or currency of such third-party sites or any information, content, products, or services accessible from such third-party sites.
Promotional Messages
The user agrees to receive both promotional and transactional messages on registering with Xume through Email or SMS.
External Software.
Xume contains barcode components Powered by Cognex Corporation. These products may only be used as part of and in connection with Xume.
App Stores.You acknowledge and agree that the availability of the Xume Sites is dependant on the third party from which you received the Mobile App (eg. Apple App Store). You acknowledge that this agreement is between you and Xume and not with the App Stores.
Limited Liabilities
IN NO EVENT SHALL MAJA SOLUTIONS LLP AND ITS PARTNERS, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, AGGRAVATED, ECONOMIC OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING OR ARISING OUT OF OR IN ANY WAY RELATED TO THE USE, OR THE INABILITY TO USE OR ACCESS THE SITES OR ANY INFORMATION OR OTHER MATERIALS AVAILABLE ON OR THROUGH THE SITES (INCLUDING WITHOUT LIMITATION THE DATABASE AND SEARCH ENGINE) RESULTS IN THE NEED FOR SERVICING, REPAIR OR CORRECTION OF EQUIPMENT OR DATA, FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR WEBSITES, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR WEBSITES, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR WEBSITES BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA Xume WEBSITES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. THE WEBSITES ACCESS BEING FREE TO THE USER, THE USER CANNOT ASSUME ANY COSTS THEREOF. UNDER NO CIRCUMSTANCES SHALL THE CUMULATIVE TOTAL LIABILITY OF Xume TO YOU ARISING UNDER THIS AGREEMENT FOR ANY CAUSE WHATSOEVER BE GREATER THAN Rs.100/-.YOU SPECIFICALLY ACKNOWLEDGE THAT Xume SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.
The Xume Sites are controlled and offered by MAJA Solutions LLP through rented facilities / servers. Xume makes no representations that the Xume Sites are appropriate or available for use in other locations. Those who access or use the Websites from other jurisdictions do so at their own volition and are responsible for compliance with local law.
IndemnityYou agree to defend, indemnify and hold harmless MAJA Solutions LLP its partners, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Xume Sites; (ii) your violation of any term of these Terms of Use; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your User Submissions caused damage to a third party. This defense and indemnification obligation will survive these Terms of Use and your use of the Xume Sites.
Fee-Shifting, Choice of Law. If you attempt to bring any legal action against Xume based in any way on its products or services, including Xume web, database, e-mail, and/or mobile application properties, you agree that, in the event you do not prevail or Xume does prevail, you will reimburse Xume for any costs and attorneys fees associated with Xume defense of the action. Use of or access to Xume web, database, e-mail, and/or mobile application properties and any claim or dispute relating to Xume web, database, e-mail, and/or mobile application properties shall be governed by the laws of India, without regard to its conflicts of law principles. Any claims, disputes, or litigation arising in connection with the use of or access to Xume web, database, e-mail, and/or mobile application properties will be brought solely in the courts of Mumbai, and you consent to the jurisdiction of such courts. Use of or access to Xume web, database, e-mail, and/or mobile application properties is unauthorized in any jurisdiction that does not give full effect to all provisions of these terms of service, including without limitation this paragraph. If any provision or portion of these terms and conditions is held in whole or in part to be unenforceable for any reason, the remainder of that provision and of the entire User Agreement will be severable and will remain in effect, to the fullest degree consistent with the intent of this document.
